TERMS AND CONDITIONS

General Terms and Conditions for Waves of Arohanui

(Version: January 2025)

 

1. Scope of Application

These General Terms and Conditions (hereinafter referred to as "GTC") apply to all legal transactions between:

(hereinafter referred to as “we” or “us”)

 

and our clients.

The GTC apply to agreements made via email, contact forms, or other online communication methods.

The only legally binding language for the agreement is English. Any translations are provided for informational purposes only.

By engaging in services with us, clients accept these GTC. Deviating terms by clients are only recognized if explicitly agreed upon in writing.

2. Applicable Law and Consumer Protection

These terms are governed by the laws of the Federal Republic of Germany, excluding the provisions of international private law and the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer as defined by §13 BGB and reside in a European Union country, local mandatory legal consumer protection regulations may apply in addition to German law.

The version of the GTC in effect at the time of booking applies.

3. Subject of the Agreement

Our services focus on frequency coaching and may include:

 

Individual Coaching

Frequency Alignment Recommendations

Consultations via phone, video call, or message.

4. Pricing and Payment Terms

Our prices are net prices; no VAT is charged according to §19 UStG.

Clients are informed of the costs individually via email or other messaging platforms before engaging in services.

Payments are due immediately upon receipt of the invoice. Access to our services is granted only after full payment.

Installment payment plans can be agreed upon individually.

5. Formation of the Contract

Contact with us is initiated via email, phone, or the contact form on our website.

After clarifying your needs and discussing costs, the client confirms their intent to proceed via email or message.

Upon confirmation and receipt of payment, the agreement is finalized, and services commence.

6. Duration and Termination

The agreement is automatically fulfilled upon the delivery of the agreed service or guidance.

Either party may terminate the agreement with immediate effect for good cause, such as repeated non-payment or significant breaches of these terms.

7. Service Delivery and Format

Our coaching services are provided online through phone, video calls, or messages.

We do not offer in-person sessions.

Service durations are discussed individually but typically do not exceed 60 minutes per session.

8. Cancellation and Refund Policy

Appointments must be canceled at least 24 hours in advance. Otherwise, the full fee is charged.

Frequent cancellations by the client may result in a refusal to reschedule, and payments are retained without refunds.

If a client chooses to discontinue coaching, no refund will be provided unless valid medical documentation is submitted.

9. Consumer Right of Withdrawal

As a consumer, you have the right to withdraw from this agreement within 14 days of booking without providing a reason, unless the service has already been fully delivered within that period.

If you withdraw, any payments made will be refunded within 14 days, provided no services have already been rendered.

10. Intellectual Property and Usage Rights

Any materials (e.g., PDFs, guides, or instructions) provided during coaching sessions are for personal use only. Sharing or commercial use is strictly prohibited without prior written consent.

All intellectual property, including ideas and concepts, remains the property of Waves of Arohanui.

11. Confidentiality

Both parties agree to treat all shared information as confidential.

Information shared during coaching sessions will not be disclosed to third parties without prior written consent.

12. Limitation of Liability

We do not guarantee specific outcomes from our coaching services. The implementation of recommendations and their results depend solely on the client.

We are only liable for damages caused by intentional or grossly negligent behavior.

13. Force Majeure

In cases of events beyond our control (e.g., natural disasters, pandemics), both parties agree to suspend obligations until the event is resolved.

14. Final Provisions

These terms and conditions represent the entire agreement between the parties.

Should individual clauses of these terms be invalid, the remaining provisions remain unaffected.

For any disputes, the jurisdiction is Hamburg, Germany, unless consumer protection laws specify otherwise.
